Inspiration Cruises – Terms & Conditions
These Terms and Conditions apply to all charters booked with Inspiration Cruises, operated by Gisbro Pty Ltd (ABN 99 158 703 569). By confirming a booking or making payment, you agree to the following terms.
1. Bookings, Deposits & Payments
- A $500 deposit (or full payment) is required to secure your booking. This deposit is strictly non-refundable.
- The remaining balance is due no later than 14 days before your cruise date.
- Failure to pay by this date may result in cancellation of your booking and forfeiture of all monies paid.
- Accepted payment methods: bank transfer or credit/debit card (surcharges may apply).
2. Cancellations & Rescheduling
- All payments made to secure or confirm a booking are strictly non-refundable, regardless of notice period or reason for cancellation.
- If a charter is cancelled, rescheduled, or reduced by the client for any reason (including change of mind, illness, weather concerns, or travel delays), all monies paid will be forfeited.
- At the discretion of Inspiration Cruises, funds may be held as a credit toward a future cruise. Credits do not expire and can be applied to any available future date.
- No-shows or cancellations on the day of the charter will result in 100 % forfeiture of all payments.
- If Inspiration Cruises must cancel due to unsafe weather, mechanical issues, or operational reasons, guests will be offered a rescheduled date or a credit valid for 12 months. Refunds are not offered except where required by Australian Consumer Law.
Travel Insurance: All guests — especially interstate or international visitors — are encouraged to obtain travel insurance to cover unforeseen changes of plans.
3. Weather & Safety
- Cruises proceed in most weather conditions, including light rain and overcast skies. Refunds are not issued for weather unless the skipper deems it unsafe to operate.
- Light rain or cloudy conditions do not affect comfort; the vessel’s interior and flybridge are fully covered.
- If conditions are unsafe to operate, guests will be offered a rescheduled date or a credit valid for 12 months. Refunds are not offered except where required by Australian Consumer Law.
- The skipper’s decision regarding weather or safety is final.
- All cruises are conducted within sheltered inland waterways — not open ocean.
- Guests must follow crew instructions at all times. Failure to do so may result in early termination without refund.
- Decks may be slippery when wet; please take care and use handrails when moving around the vessel.
4. Responsible Behaviour Onboard
- BYO alcohol and food are permitted; responsible behaviour is expected at all times.
- No illegal substances are permitted. Aggression, property damage, or serious misconduct will result in immediate termination without refund.
- The booking party is responsible for ensuring all guests behave respectfully and follow crew instructions.
5. Bond & Damage
- A security bond may be required depending on group size or event type.
- The booking party is responsible for any damage, breakage, theft, or loss caused by any guest, whether accidental or due to negligence, intoxication, or misconduct.
- Repair or replacement costs will be charged at commercial rate, including labour and materials.
- If the vessel becomes unavailable for future bookings due to damage or cleaning, the booking party is liable for the loss of charter income.
- A minimum $500 cleaning fee applies if bodily fluids or excessive mess occur.
- Unpaid repair or cleaning costs will be invoiced and must be paid within 7 days.
6. Guest List & Capacity
- Maximum capacity: 25 passengers plus crew.
- Final guest numbers are due 48 hours prior to departure.
- Additional guests beyond confirmed numbers may be refused boarding for safety reasons.
7. Pickup, Departure & Timing
- Main departure: Surfers Paradise Public Pontoon, 73 Cavill Avenue QLD 4217 (beside Cowboys Bar & Grill).
- Secondary pickup: 10 Ferny Avenue, Surfers Paradise QLD 4217 (near Surfers Pavilion).
- Please arrive 10–15 minutes early for smooth boarding.
- Late arrival may reduce total cruising time; the schedule cannot be extended.
- Alternative pickup/drop-off points can be arranged by prior agreement and may incur a surcharge.
- Inspiration Cruises may adjust departure times or locations due to factors beyond our control (e.g. marina works, tides, public pontoon access). Guests will be notified where possible.
8. Liability & Risk
- All guests board and participate in any onboard or water-based activities entirely at their own risk.
- Gisbro Pty Ltd trading as Inspiration Cruises accepts no liability for injury, loss or damage howsoever caused.
- This includes but is not limited to swimming, use of inflatables, stand-up paddle boards (SUPs), lily pads, and any other water equipment supplied or brought onboard.
- Guests must follow crew instructions at all times and use handrails when moving around.
- No high heels or black-soled shoes permitted; clean deck shoes or grip socks recommended.
- Guests acknowledge decks may be slippery when wet and waive any claim against the operator for injury or loss arising from such incidents.
- Inspiration Cruises is not responsible for property left onboard after the cruise.
9. Swimming & Water Activities
- Swimming is only permitted with the captain’s approval, based on conditions and guest safety.
- All water activities are at guests’ own risk, including use of any inflatables, SUPs or equipment.
- Life jackets are available on request and may be required at the captain’s discretion.
10. Photography & Promotion
- Guests are welcome to take personal photos and videos onboard.
- Inspiration Cruises may capture promotional images during charters; advise the crew before departure if you prefer not to be included.
11. Privacy
- All contact details are used strictly for booking and safety purposes.
- Your information is never shared with third parties without consent.
12. Third-Party Bookings
If your cruise was booked through an agency or partner platform, these Terms & Conditions apply in full. By boarding the vessel, you accept these terms regardless of booking method.
13. Indemnity
The booking party agrees to indemnify and hold harmless Gisbro Pty Ltd, its owners and employees from any claims or losses (including legal fees) arising from the acts or negligence of any guest in their group.
14. Agreement
By paying your deposit or any portion of the charter fee, you confirm your acceptance of these Terms & Conditions and acknowledge that all guests have been made aware of their responsibilities while onboard. Inspiration Cruises reserves the right to update these terms at any time without prior notice.
